Membership is a legal relationship
A formal membership application also creates a legal record. When a new member accepts the statutes by signing the form, that acceptance is documented. This matters in the rare but real situations where a member's behaviour leads to disciplinary action or expulsion — the association can show that the member knew and accepted the rules.
Swiss associations are governed by ZGB Art. 60-79, which grants them considerable autonomy to define their own membership rules in their statutes. This form is intentionally flexible: membership categories, fees, and committee names can all be adapted to match your specific statutes. Swiss Vereinsrecht — ZGB Art. 60-79
Under Swiss law, an association (Verein) is a voluntary union of persons with a common non-commercial purpose (ZGB Art. 60). Membership conditions, categories and fees must be defined in the association's statutes. This form includes a statutes-acceptance question to create a clear record that the new member has accepted the Statuten — which is important if a membership is later disputed or terminated.

Membership categories under Swiss Vereinsrecht
- Ordentliche Mitglieder (ordinary members): full voting rights, subject to full membership fee, counted for quorum
- Studentenmitglieder (student members): reduced fee, typically full voting rights, requires proof of enrolment
- Gonner / Fordermitglieder (supporting members): contribute financially or in kind, typically no voting rights
- Ehrenmitglieder (honorary members): awarded by the general assembly, no fee, may or may not have voting rights depending on statutes
For associations with multiple membership categories (ordinary, student, supporting, honorary), a structured form prevents errors. Members can self-select their category, and your committee can verify and approve — rather than trying to infer intent from an unstructured email.

Is member data subject to the Swiss nFADP?
Yes. Member data — name, address, date of birth, payment details — is personal data under the nFADP. As a controller, the association must inform members of the purpose of data collection, their right to access and deletion, and store the data securely. This form includes a consent block that covers these requirements.
Does the form need to reference our specific statutes?
Best practice is to include a link to your statutes in the acceptance question — for example: 'I have read the statutes available at [URL] and accept them.' You can edit the description text of the acceptance question to include your statutes URL.
Can an honorary member be added via this form?
Honorary membership is typically conferred by a vote of the general assembly (Generalversammlung), not via self-application. You may wish to disable the honorary option in the membership category field and use the form only for self-applications, processing honorary memberships separately through your committee.
